If unplugging the assembly allows the lights to turn off,  I am certain that replacing the assembly will fix your problem.

nope even before i had this problem, if i disconnected the switch the lights would stay on

It may be different than the older ones.  The symptoms you are having are identical to the symptoms when the trace opens in the ones from a few years ago.  Keep us posted and let us know if you figure it out.

so i got the new assembly in and everything is back to normal. Thanks to everyone who try to help

make sure to tell him not to replace the switch until you correct the wiring or it will burn open the new switch right away as well...... the proper way to grab parklights at the switch is doing it with a relay to open the feed wire and apply the feed (negative) to the negative wire at the other side of the switch.... works fine this way.....
